The legal battle over President Biden’s sweeping student loan forgiveness plan is coming to a head next week, as the Supreme Court prepares to hear oral arguments to determine the fate of the initiative.

In the second challenge, a conservative-leaning group representing two student loan borrowers argued that the Biden administration acted arbitrarily in how it set up the program — counterintuitively, by excluding commercial FFELP loans from relief, and by setting limits on the amount of student loan forgiveness a borrower would be entitled to, without allowing for a period of public comment.that none of these parties have standing to sue.

Both the Biden administration and the Trump administration relied on the HEROES Act to implement and extend relief under the ongoing student loan pause in response to the Covid-19 pandemic. Both administrations paused student loan payments, froze interest, and suspended collections efforts under this statutory authority.

But opponents of mass student loan forgiveness argue that the Biden administration has gone too far, and that the HEROES Act does not contemplate such wide-scale student debt cancellation. “The Biden Administration does not have the authority to unilaterally ‘forgive’ student loan debt across the board, and attempting to do so is nothing more than a political maneuver.
